These Terms of Service govern your use of the Costcard app. By using Costcard, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the Costcard app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Costcard ("we," "us," or "our").

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Costcard is an iOS application that allows you to:

• Scan and digitize Costco receipts and shelf price tags using AI-powered OCR
• Track the prices of items you've purchased over time
• Receive push notifications when prices drop on items you've bought
• File price adjustment claims based on detected price drops (within Costco's 30-day policy)
• Browse trending deals, price drops, and popular items in your region
• Track your pantry inventory built from scanned receipts
• Manage a shared household shopping list with voice input support
• Mark and track items for return
• Explore the app in Demo Mode before creating an account

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

3. User Accounts

Costcard uses a device-based identity system. When you first launch the App, a unique account identifier is generated for your device. This identifier links your receipts, claims, and settings without requiring you to create an account with a username or password.

• Apple Sign In (optional) — you may optionally sign in with Apple to link your account across multiple devices and enable recovery if you lose your device. This step is not required to use the App.
• One account per device — each device is associated with one Costcard account. Attempting to circumvent this restriction is a violation of these Terms.
• Account security — you are responsible for maintaining the security of your device. We are not responsible for any loss or damage resulting from unauthorized access to your account.

4. Acceptable Use

Costcard is intended for personal, non-commercial use only. You agree that you will not:

• Use the App for any commercial purpose, including reselling price data or building competing products using data gathered through the App
• Attempt to scrape, harvest, or systematically extract data from the App or its underlying services
• Submit false, fraudulent, or fabricated receipts
• Abuse the price alert or claim system by filing claims you know to be inaccurate or ineligible
• Attempt to reverse engineer, decompile, or tamper with the App or its backend services
• Use automated tools, bots, or scripts to interact with the App
• Interfere with or disrupt the integrity or performance of the App or its services
• Violate any applicable local, state, national, or international law or regulation

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these acceptable use provisions.

5. Costco.com Import

The Import feature allows you to access your own Costco.com purchase history through an in-app browser (WKWebView). You log into Costco's website directly — Costcard does not access, store, or transmit your Costco username or password. You are responsible for complying with Costco's terms of service when using this feature. We make no representation that this feature will remain available, as it depends on Costco.com's website structure and policies.

6. Coupon Book and Deal Data

Deal and savings information displayed in the Coupon Book feature is sourced from publicly available Costco promotional materials and third-party aggregators. We do not guarantee the accuracy, completeness, or availability of these deals. Prices, availability, and promotion dates may vary by warehouse location. Always verify deals in-store before making purchasing decisions based on information in the App.

7. Receipt Data

You own the receipt data you submit to Costcard. We process it solely to provide the service to you — including extraction, price tracking, alert generation, and claim management. We do not use your receipt data for advertising, sell it to third parties, or share it beyond what is necessary to operate the App.

• Your right to delete — you can delete individual receipts or your entire account and all associated data at any time from within the App, or by contacting us at [email protected].
• Processing by AI — receipt images are processed using AI to extract item names and prices. This processing is performed by third-party AI services subject to their own terms. Images are not used to train AI models.
• Data retention — your data is retained for as long as your account is active. Upon account deletion, your data is permanently removed from our systems within 30 days.

8. Intellectual Property

The App, including its design, code, graphics, user interface, and all content we create or curate (such as trending deal summaries and product categorizations), is the intellectual property of Costcard and is protected by copyright, trademark, and other applicable laws.

• Our content — you may not copy, modify, distribute, sell, or create derivative works from any part of the App or its content without our express written permission.
• Your data — the receipt images you upload and the data derived from your personal receipts remain yours. We claim no ownership over your receipt contents or purchase history.
• Feedback — if you submit feedback, suggestions, or ideas to us, you grant us a royalty-free, perpetual license to use and incorporate that feedback into the App without any obligation to compensate you.

Costcard is not affiliated with, endorsed by, or in any way officially connected to Costco Wholesale Corporation or any of its subsidiaries.

9. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

• Price data accuracy — price information displayed in the App is for informational purposes only. Prices are extracted from your receipts and may not reflect current in-store prices. We make no guarantee that price drop alerts are accurate, complete, or timely.
• Claim eligibility — we do not guarantee that any identified price drop will result in a successful refund or price adjustment from Costco. Claim eligibility and approval are solely at Costco's discretion, subject to their return and price adjustment policies.
• No affiliation with Costco — Costcard is an independent third-party application. We are not affiliated with, sponsored by, or endorsed by Costco Wholesale Corporation. "Costco" and related marks are trademarks of Costco Wholesale Corporation.
• Service availability — we do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Costcard and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost data, loss of goodwill, or service interruption — arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $10.00.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

11. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you within the App before the changes take effect.

Your continued use of the App after updated Terms are posted constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the App.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
